General Terms & Conditions
Use of the Discovery Villas site is open to anyone who uses it for the purpose for which it was designed.
No persons other that those authorized by Discovery Villas Ltd, in writing, may add, amend or delete any information on the site. The only exception is that a registered member may edit their own advert.
No part of the Discovery Villas site may be copied except for personal use.
No links are permitted from external sources to resources within the Discovery Villas web site (including images) without prior permission in writing from Discovery Villas Ltd
The Discovery Villas site may not be used to transfer spam, viruses, or used for any other malicious purposes.
Discovery Villas will not be held responsible for any damage, loss of information, corruption, or any other problems caused by using the site.
All resources used (i.e. Pictures) are assumed to be license free and available to the public.
All information is assumed to be correct at the time it was added to the site.
Any information provided should be checked with the relevant persons, authorities or organisations before travelling.
We reserve the right to add, amend or remove any of our services at any time and without notice.
Any claims made by Discovery Villas Ltd and its staff are believed to be correct at the time they were made.
We have separated some of the Terms & Conditions into groups for clearer reading. However, this does not mean that those terms should be interpreted as being exclusively for that category
If these terms and conditions have been translated into any other language which results in a difference of these terms then the English version will take precedence over the other language and are subject to UK law.
Additional Terms For Holiday Makers:
Discovery Villas Ltd is completely independent from all advertisers and appearing on the site does not represent an endorsement by Discovery Villas Ltd.
Discovery Villas Ltd will not be held liable for any incorrect information provided by advertisers.
It is the responsibility of the holiday maker to check, or confirm, information for accuracy. We would recommend is done before entering into any booking agreement.
Any agreements entered into are strictly between the holiday maker and the advertiser.
Additional Terms & Conditions For Advertisers:
By registering with Discovery Villas Ltd you are agreeing to enter into a legally binding contract which is subject to the laws of England and Wales.
To prevent confusion, each advert may only be used to advertise one property / rental unit.
Each advert relates to a specific rental unit. Once created, the holiday rental in an advert may not be replaced by another rental unit.
All property advertising prices are per property, per year
All prices for advertising in our Holiday Essentials section are per listing, per year
By registering you accept that e-mail will be used by Discovery Villas as the primary method of contacting you.
You may only register an e-mail address which is active, valid and you have permission to use.
You may only register for one account.
You agree to inform Discovery Villas immediately if your contact information changes.
All advertisers are responsible for the maintenance of their advert and will ensure that all details are correct, accurate and up to date
All adverts will run for 12 month from the date the advert or service was registered or renewed, and not from the date that any payment was received. (Unless specified otherwise in writing)
Each advert remains the property of Discovery Villas Ltd
By adding images property owners grant Discovery Villas Ltd free use of those images (which will be added to our image stock) and agree that they may be used free of charge at any point in the future by Discovery Villas Ltd.
Unless agreed in writing with Discovery Villas Ltd, users may not upload any logo's or branding to a holiday property advert. In addition, any images may not contain any information such as telephone numers, company names, email addresses, website addresses (either as a watermark or as the image itself), or any other information which may be considered inappropriate.
Discovery Villas Ltd reserves the right to amend or remove any content from an advert which it believes to be inappropriate, misleading, out of date or otherwise incorrect
As a last resort Discovery Villas Ltd reserve the right to disable any adverts that are either incomplete or that we feel reduce the quality of the site
If an advert has been temporarily disabled or removed from the site no refund, either in part, or fully, will be payable by Discovery Villas Ltd.
It is the responsibility of the registered user to ensure that their password and account number are kept private and secure. Discovery Villas Ltd cannot be held responsible for any costs incurred due to misuse of these details.
Whilst we aim to make the site available 100% of the time we regret that we will not be able to offer any refunds for any "down time" that may be experienced by our servers.
Any special offers involving free or discounted advertising will be based on our standard advertising package, and will be limited to one advert per person, unless otherwise stated in writing.
Free trials are only available to new members unless otherwise specified in writing.
Only one promotion, discount or incentive may be used per transaction.
By renewing your advert you are also renewing your agreement to our Terms & Conditions including any additions, amendments or deletions that have been made.
Terms Regarding Payments for Advertisers:
Once an advert has been created the registered user is required to make payment in full within 14 days.
Any payments to Discovery Villas Ltd must be made in GBP Sterling unless previously agreed, in writing, by Discovery Villas.
Payments made in alternative currencies may incur an additional admin fee.
Payments still outstanding after 30 days will incur a late payment fee of £20 per month until the balance has been paid in full.
It is the responsibility of the advertiser to ensure that payment has been received and that any outstanding balances have been paid in full.
In addition to the late payment fee Discovery Villas Ltd reserve the right to disable the advert until the amount has been received in full.
Should the advert be disabled due to non payment, the advertising period will continue to run until its original expiry date.
Discovery Villas Ltd will not be held responsible for any payments that do not reach us, either via post or electronic means.
Discovery Villas Ltd will not be held responsible for the security of a transaction which is handled by a third party.
Discovery Villas Ltd reserve the right to pass on to the registered user any fees that may be incurred by a cancelled, returned or late payment.
Cancelling your advert:
You have the right to a 7 day "Cooling off" period during which you may cancel your advert and receive a full refund.
You may also cancel your advert at any time by sending your request in writing. However, please note that no refunds will be payable if an advert is cancelled by the advertiser mid-term
Your advert will automatically expire after 12 months.(Unless specified otherwise in writing). However, your account will remain active until you request its closure.
You will remain liable for any costs incurred on your account until your account has been closed.
If you sell your property you must advise Discovery Villas Ltd that you are no longer the owner of the property
You may not resell or otherwise transfer ownership of your advert.
Customer Satisfaction Guarantees
Price Match
The Discovery Villas price match is only available when comparing non commission based sites with an equal or greater range of services, features, quality and technical capability. Discovery Villas staff will provide an objective comparison and our decision is final.
Free renewal
If you have not received a single enquiry within your first year with us we will happily renew your advert for a second year, based upon your existing advert requirements, as long as all sections of your advert have been completed fully and accurately.
The free renewal is only available to members who have paid the full advertising price in the first year.
Your Privacy & The Data Protection Act (1998):
The privacy of our customers is very important to us and we will endeavour to ensure any information is handled accordingly.
Our Privacy Policy forms part of our terms and conditions.
What to do if things go wrong:
It's a very unlikely situation where something may go wrong.
However, as a responsible company Discovery Villas Ltd believes that you should know what to do if you have a complaint regarding ourselves, or one of our advertisers.
Complaints regarding a property advertised via Discovery Villas Ltd:
If you have a complaint regarding a holiday home or holiday service (i.e Flights, Car Hire, etc) then you should address this directly to the advertiser.
If you believe that the advertiser has provided misleading information then please advise us immediately, in writing, so that we can investigate the matter.
Please note that whilst we cannot take any action on your behalf, we do take misleading information seriously and we will remove any advert that we believe is in breach of our terms and conditions.
If the advertiser has not resolved the issue to your satisfaction then you may, amongst other things:
- Raise your concerns with the local Citizens Advice Bureau who can provide you with advice.
- Raise the issue with your local Trading Standards Dept who can provide you with advise or will investigate the issue.
Complaints directly regarding Discovery Villas Ltd:
Should you have a complaint regarding your account, or one of our services, you should contact us in writing, either via post or e-mail within 30 days of the alleged incident.
If your complaint has not been resolved to your satisfaction there are a number of avenues open to you:
- Address your issues directly to our Managing Director. This should be done in writing with the letter marked for his personal attention.
- Raise your concerns with the local Citizens Advice Bureau who can provide you with advice.
- Raise the issue with your local Trading Standards Dept who can provide you with advice or will investigate the issue.
By using the Discovery Villas site, either as a visitor or as an advertiser, you are agreeing to comply with the terms and conditions as stated above.
